Terms of service

TERMS OF SERVICE

OVERVIEW

This website is operated by The Parchment Leather. Throughout the site, the terms “we,” “us,” and “our” refer to The Parchment Leather. The Parchment Leather offers this website, including all information, tools, products, and Services available through this site, conditioned upon your acceptance of the terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced herein or made available by hyperlink. These Terms apply to all users of the site, including browsers, customers, merchants, vendors, and contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to these Terms. If you do not agree, you may not access the website or use our Services.

Any new features or tools added to the store will also be subject to these Terms. We may update, change, or replace any part of these Terms by posting the revised version on this website. Your continued use of the website after changes are posted constitutes acceptance of those changes, subject to any rights that cannot legally be waived under applicable consumer protection laws.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that allows us to offer our products and Services to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have authorized any minor dependents under your supervision to use this site.

You may not use our products or Services for any illegal or unauthorized purpose. You must not violate any applicable laws, including copyright, trademark, privacy, or intellectual property laws.

You must not transmit viruses, worms, malware, or other destructive code.

A breach of these Terms may result in the immediate termination of your access to our Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse Service or cancel an order where reasonably necessary, including in cases of suspected fraud, misuse, resale, pricing errors, payment issues, abusive conduct, or violation of these Terms.

Information submitted through the site, other than payment information, may be transferred across different networks and adapted to meet technical requirements. Payment information is encrypted during transmission through supported payment providers.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, website content, product designs, photographs, written materials, or access to the Service without our prior written permission.

The headings used in these Terms are included for convenience and do not affect their interpretation.

SECTION 3 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We make reasonable efforts to keep the information on this website accurate and current. However, information may occasionally contain errors, omissions, or outdated details.

The information on this site is provided for general informational purposes and should not be relied upon as the sole basis for making decisions where more complete or current information is reasonably required.

We may modify website content at any time. Nothing in this section limits our responsibility where liability cannot legally be excluded.

SECTION 4 — MODIFICATIONS TO THE SERVICE, PRICES, AND CURRENCIES

Prices, product availability, designs, options, and Services may change without notice.

We reserve the right to modify, suspend, or discontinue any product, feature, or part of the Service, subject to orders already accepted and any obligations required by applicable law.

Prices may be displayed in different currencies depending on the customer’s selected country or market. The final currency and amount payable will be shown at checkout. Banks, card issuers, PayPal, or other payment providers may apply their own exchange rates or foreign transaction fees, which are outside our control.

Unless expressly stated otherwise at checkout, customers are responsible for applicable customs duties, import taxes, brokerage fees, or similar destination-country charges. These charges are not payments collected by The Parchment Leather and are generally non-refundable by us, except where required by law.

SECTION 5 — PRODUCTS OR SERVICES

Our products are handmade in Canada and may be available exclusively through our online store. Quantities may be limited, and certain products may only be released or made available during scheduled releases.

Most of our products are handmade to order. The production lead time shown on the relevant product page refers to the estimated time before shipment and does not include shipping transit time. Production begins after we receive the order, payment, selected product options, and any required personalization information.

Because our products are handmade, minor differences between individual pieces may occur. Natural leather can contain variations in grain, texture, shade, markings, and surface character. These natural variations are not automatically considered defects.

We make reasonable efforts to display product colours and images accurately. However, colours may appear differently depending on screen settings, lighting, photography, and natural material variation.

Customers are responsible for checking all selected options, colours, sizes, personalization text, spelling, capitalization, and placement instructions before placing an order. We are not responsible for mistakes contained in information submitted or approved by the customer.

Orders cannot normally be cancelled or modified after they have been placed because materials may be allocated, cut, prepared, or personalized specifically for that order. Any permitted cancellation, modification, return, exchange, replacement, or refund remains subject to our applicable policies and to rights that cannot legally be excluded.

Products made to the customer’s specifications or clearly personalized may be ineligible for change-of-mind cancellation or return where permitted by applicable law. This does not remove the customer’s legal rights if an item is defective, damaged, materially different from its description, or incorrect because of our error.

Products are subject to return, exchange, replacement, or refund only as described in our Refund Policy and as required by applicable law:

Refund Policy:

We may limit sales by person, household, order, geographic region, or jurisdiction on a reasonable case-by-case basis. We may also limit quantities or discontinue products at any time.

All product designs, patterns, artwork, photographs, videos, written descriptions, branding, and related creative materials are owned by or licensed to The Parchment Leather and may not be copied, reproduced, manufactured, distributed, or used commercially without prior written permission.

SECTION 6 — BILLING, ORDER, AND ACCOUNT INFORMATION

We reserve the right to reject, limit, or cancel an order where reasonably necessary. This may include orders placed using the same customer account, payment method, billing address, shipping address, or other information associated with suspected fraud, unauthorized resale, pricing mistakes, or misuse of the website.

If we change or cancel an order, we may contact you using the email address, telephone number, billing information, or shipping information supplied with the order.

You agree to provide complete, current, and accurate order, billing, shipping, contact, and account information. You must promptly update relevant information so that we can process your order and contact you when necessary.

We are not responsible for delivery delays, failed delivery, address correction charges, loss, or additional shipping expenses caused by an incomplete or incorrect address supplied by the customer. If a parcel is returned to us because of an incorrect address, refusal, non-collection, or unpaid import charges, additional shipping costs may apply before it can be sent again.

Orders are only accepted after successful payment authorization and confirmation from us. An automated order acknowledgment does not prevent us from correcting an obvious pricing, inventory, or technical error.

For information about returns, replacements, and refunds, please review:

Refund Policy:

SECTION 7 — OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to third-party tools, payment providers, applications, or integrations that we do not directly control.

These tools are provided on an “as is” and “as available” basis, subject to the third party’s own terms and privacy practices. Your use of optional third-party tools is at your own discretion.

We may introduce new features, Services, applications, or resources in the future. These additions will also be subject to these Terms where applicable.

SECTION 8 — THIRD-PARTY LINKS AND SERVICES

Certain content, products, payment methods, shipping services, or other features available through our Service may involve third parties.

Third-party links may direct you to websites that are not operated by us. We are not responsible for independently examining or guaranteeing third-party website content, policies, availability, security, or accuracy.

Please review the relevant third party’s terms and policies before completing a transaction. Questions or complaints concerning a third-party product or service should generally be directed to that third party, without limiting any rights you may have against us under applicable law.

SECTION 9 — REVIEWS, COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit a review, photograph, comment, suggestion, creative idea, or other non-confidential material to us, you grant The Parchment Leather a non-exclusive, worldwide, royalty-free licence to reproduce, edit, translate, publish, display, and share that material for purposes connected with our business, website, products, and marketing.

This licence does not give us ownership of your personal information, and our handling of personal information remains subject to our Privacy Policy.

We may monitor, edit, decline, or remove content that we reasonably believe is unlawful, abusive, defamatory, discriminatory, obscene, misleading, infringing, fraudulent, or otherwise inappropriate.

You confirm that your submissions will not violate another person’s copyright, trademark, privacy, publicity, or other rights. You must not submit false information, impersonate another person, or transmit malware.

You remain responsible for the content and accuracy of your submissions.

SECTION 10 — PERSONAL INFORMATION

Your submission and our handling of personal information through the store are governed by our Privacy Policy:

Privacy Policy:
https://theparchmentleather.com/policies/privacy-policy

Please do not submit passwords, payment card details, government identification numbers, or other unnecessary sensitive information through our contact form, product personalization box, reviews, or ordinary email.

SECTION 11 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, our website or Service may contain typographical errors, inaccuracies, or omissions concerning product descriptions, availability, pricing, promotions, shipping charges, production times, transit times, currency display, or other information.

We reserve the right to correct errors, update information, or cancel an affected order where reasonably necessary, including after an order has been submitted.

If an order is cancelled because of our pricing, inventory, or technical error, amounts paid for the cancelled item will be refunded using the original payment method, subject to the payment provider’s processing time.

Nothing in this section limits rights or remedies that cannot legally be excluded.

SECTION 12 — PROHIBITED USES

You are prohibited from using the site or its content:

  • For any unlawful purpose

  • To solicit or participate in unlawful acts

  • To violate applicable laws, regulations, rules, or ordinances

  • To infringe our intellectual property rights or the rights of others

  • To harass, abuse, threaten, defame, intimidate, or unlawfully discriminate

  • To submit false or misleading information

  • To transmit viruses, malware, or malicious code

  • To collect or track another person’s personal information unlawfully

  • To spam, phish, scrape, crawl, or interfere with the website

  • To impersonate another person or misrepresent your identity

  • To circumvent security, purchase limits, geographic restrictions, or other protective features

  • To reproduce or commercially exploit our product designs, images, patterns, or written content without permission

We may suspend or terminate access to the Service for violating these restrictions.

SECTION 13 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee that the website will always be uninterrupted, timely, secure, or error-free. We may temporarily suspend all or part of the Service for maintenance, technical, security, or operational reasons.

To the fullest extent permitted by law, the website and Services are provided on an “as is” and “as available” basis, except for any express product commitments made by us.

To the fullest extent permitted by law, The Parchment Leather and its owners, employees, contractors, agents, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential loss arising from the use of the website or Services.

Nothing in these Terms excludes, restricts, or limits any warranty, condition, consumer right, remedy, or liability that cannot lawfully be excluded or limited. Where a jurisdiction does not permit a particular exclusion or limitation, that exclusion or limitation will apply only to the maximum extent permitted by law.

SECTION 14 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless The Parchment Leather and its owners, employees, agents, contractors, service providers, suppliers, and licensors from third-party claims reasonably arising from:

  • Your material breach of these Terms

  • Your unlawful use of the website or Services

  • Content or instructions submitted by you that infringe another party’s rights

  • Your violation of applicable law

This section does not require you to indemnify us for losses caused by our own negligence, misconduct, or violation of applicable law.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue to be valid and enforceable.

SECTION 16 — TERMINATION

These Terms remain effective unless terminated by you or us.

You may stop using our Services at any time. We may suspend or terminate access where we reasonably believe that you have materially violated these Terms, used the Service unlawfully, interfered with website security, or failed to pay amounts properly due.

Termination does not affect rights, payment obligations, liabilities, or remedies that arose before termination.

SECTION 17 — ENTIRE AGREEMENT

These Terms, together with policies and operating rules posted on our website, constitute the agreement between you and The Parchment Leather concerning your use of the website and Services.

They supersede previous communications or versions concerning the same subject matter.

Our failure to exercise or enforce a provision does not constitute a waiver of that provision.

Any ambiguity in these Terms will be interpreted fairly and in accordance with applicable law, rather than automatically in favour of either party.

SECTION 18 — GOVERNING LAW

These Terms and any separate agreements through which we provide Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Nothing in this section deprives a consumer of mandatory protections or rights that apply under the laws of the consumer’s country, state, or province of residence.

SECTION 19 — CHANGES TO THESE TERMS

You may review the current version of these Terms on this page at any time.

We may update or replace parts of these Terms by posting a revised version on our website and updating the “Last updated” date.

Where required by law, we will provide additional notice or obtain consent before a material change takes effect.
